Terms Of Service

1. Introduction

This License Agreement ("Agreement") governs your use of services, software, and related products provided by Hostergy, a subsidiary of Elite Concepts, Inc. By accessing or using our services, you agree to be bound by this Agreement.

2. Grant of License

Hostergy grants you a non-exclusive, non-transferable, revocable license to use our hosting services, control panels, and any associated software (collectively, "Services") solely for your personal or business use, subject to this Agreement and our Terms of Service.

3. Restrictions

You may not:

• Copy, modify, distribute, or reverse-engineer any software provided by Hostergy.
• Use the Services for illegal activities or in violation of our Acceptable Use Policy.
• Transfer or sublicense the Services to third parties without prior written consent.

4. Ownership

All intellectual property rights in the Services, including software, trademarks, and documentation, remain the property of Elite Concepts, Inc. or its licensors. This Agreement does not grant you ownership of any kind.

5. Third-Party Software

Some Services may include third-party software (e.g., cPanel, WordPress) subject to separate license agreements. You agree to comply with those terms, and Hostergy is not responsible for third-party software performance or compliance.

6. Updates and Support

Hostergy may provide updates or patches to the Services at our discretion. Technical support is provided as outlined in your service plan, but we do not guarantee resolution of all issues.

7. Termination

This license terminates if:

• You breach this Agreement or our Terms of Service.
• Your hosting account is terminated or expires.

Upon termination, you must cease using the Services and destroy any copies of associated software.

8. Disclaimer of Warranties

The Services are provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted operation.

9. Limitation of Liability

Hostergy and Elite Concepts, Inc. are not liable for indirect, incidental, or consequential damages arising from your use of the Services. Our liability is limited to the fees paid by you in the preceding 12 months.

10. Governing Law

This Agreement is governed by the laws of the United States and the state in which Elite Concepts, Inc. is incorporated, without regard to conflict of law principles.
